Non-Exclusive License
- The Modeling Market Non-Exclusive License grants you, the purchaser, an ongoing, exclusive, worldwide license to make use of the Package (in whole or in part) you have selected. Read the rest of this license for the details that apply to your use of the Package (in whole or in part), as well as the FAQs (which form part of this license).
- You are licensed to use the Package (in whole or in part) to create End Products for yourself, your company or for your direct clients. You can create more than one different End Product. For all uses including websites, there is no limit of copies across all products.
- An End Product is a work created using skill and effort, and that incorporates the Package in whole or in part and may at times contain other things, so that it is larger in scope and different in nature than the Package (in whole or in part).
For example: a photo in a package is licensed and used in a free or for pay e-book distributed to up to unlimited end users. - You can create an End Product for a client, and you can transfer that single End Product to your client for any fee. This license is then transferred to your client.
- You can distribute the End Products for Free or for a fee.
- You can modify or manipulate the Package (in whole or in part). You can combine the Package (in whole or in part) with other works and make a derivative work from it. The resulting works are subject to the terms of this license. You can do these things as long as the End Product you then create is one that’s permitted under clause 3. For example: You can license an image, crop it and then use it in a website.
- You can’t Sell the End Product, except to one client who is prohibited from reselling the End Product.
- This license is a multiple use license allowing use in more than one End Product (up to the limit stated in clause 2), but it is not a multi-client license. If you are creating End Products for more than one client, you will need one license per Package (in whole or in part) per client.
- You can’t re-distribute the Package (in whole or in part) as stock, or in a tool or template. You can’t do this with an Package (in whole or in part) either on its own or bundled with other Package (in whole or in part)s, and even if you modify the Package (in whole or in part). You can’t re-distribute or make available the Package (in whole or in part) as-is or with superficial modifications. These things are not allowed even if the re-distribution is for Free. For example: You can’t license an image and then re-distribute it as a digital wallpaper.
- You can’t use the Package (in whole or in part) in any application allowing an end user to customize a digital or physical product to their specific needs, such as an “on demand”, “made to order” or “build it yourself” application. You can use the Package (in whole or in part) in this way only if you purchase a separate license for each final product incorporating the Package (in whole or in part) that is created using the application. Examples of “on demand”, “made to order” or “build it yourself” applications: “create your own” slideshow apps, and e-card generators. You will need one license for each product created by a customer, or contact us [link to support page] to discuss.
- You must not permit an end user of the End Product to extract the Package (in whole or in part) and use it separately from the End Product.
- You can’t use an Package (in whole or in part) in a logo, trademark, or service mark. You can’t use an Package (in whole or in part) in a way that infringes anyone else’s trademark or intellectual property rights.
- You can only use the Package (in whole or in part) for lawful purposes. Also, if an Package (in whole or in part) contains an image of a person, even if the Package (in whole or in part) is model-released you can’t use it in a way that creates a fake identity, implies personal endorsement of a product by the person, or in a way that is defamatory, obscene or demeaning, or in connection with sensitive subjects. For Adult sensitive material, you must obtain an Adult License.
- This license can be terminated if you breach it. If that happens, you must stop making copies of or distributing the End Product until you remove the Package (in whole or in part) from it.
- The author of the Package (in whole or in part) retains ownership of the Package (in whole or in part) but grants you the license on these terms. This license is between the author of the Package (in whole or in part) and you. Modeling Market or its parent Mad Hat Media LLC is not a party to this license or the one giving you the license.
